The arbitrator acknowledged Komerční banka’s claims on all counts of the complaint. The arbitrator confirmed a violation of the verbal trademark “Komerční banka”, registered by the bank on 2 April 2004, as well as the non-existence of the domain name speculator’s legal claim to the registration of a domain name containing the trademark “Komerční banka”. Last but not least, the arbitrator accepted the evidence that clearly proved the intent of the then holder of the komercnibanka.biz domain name to use the domain name for speculation.
Under the decision of 27 July 2010, the komercnibanka.biz domain name was transferred to Komerční banka’s ownership and rerouted to www.kb.cz.
